Article 12 OFFICERS

12.1 Officers

The use of the word "officers" means all employees and staff engaged by the Council to carry out its functions. The word has been used instead of "employees" to cover those under short term agency or other non-employed situations. Officers of the Council serve all 57 members of the Council.

12.2 Management structure

General

The Council may engage such staff (referred to as officers) as it considers necessary to carry out its functions

Chief Officers

The Council will engage persons for the following posts who will be designated as Chief Officers:

· Chief Executive (and

Head of Paid Service)

· Executive Directors

Functions of the Chief Officers

1. Chief Executive

To be the Head of the Council’s Paid Services and have authority over all other Officers but having regard to the separate responsibilities of certain officers where this has been imposed by statute.

To ensure the Authority is provided with sound advice on corporate and policy issues.

To lead the Executive Board.

As Head of Paid Services and as the Head of the Executive Board to develop and maintain a responsive, caring and cost effective organisation to implement the policies and decisions of the Council.

To establish and maintain at all levels within the Council a common sense of purpose and direction to respond positively to Local and Central Government changes.

To develop and obtain agreement for the Council’s corporate plans in order to achieve the Authority’s core objectives.

To oversee the development, implementation and management of the new Authority’s organisation, committee and cultural changes.

To develop a collective responsibility within the Executive Board through the development of cohesive corporate objectives and policy formulation.

To foster good internal relationships and communications at all levels both internal and external.

To establish a positive management style and clear vision of the future direction of the Authority and to ensure this is known to all concerned and translated into positive programmes and action plans.

To oversee co-ordinated service delivery and customer care across the whole Authority and to promote new initiatives and gain active support from all areas of the organisation and community.

To develop and implement and monitor Performance Management to encompass the new Authority’s full range of services, objectives and priorities and ensure their achievement within agreed targets.

To ensure that where necessary all policy formation and strategic issues submitted to the Council have first been considered by the Executive Board and are implemented in accordance with Council instructions.

To foster a partnership between Members, Officers and the community and represent the Authority as appropriate at meetings with outside bodes, thereby establishing the image of the Council as an organisation and employer.

To encourage the optimum use of the Authority’s resources throughout the Council’s services.

To meet specific statutory requirements

To co-ordinate the major objectives, policies and decisions of the Council in order to ensure their effective implementation.

To report to the Council any apparent neglect or failure to implement the Council’s decisions.

To ensure adherence with this Constitution, legislation and Codes of Practice.

To appraise on a regular basis the achievements and performance of individual Directors and the Executive Board.

Executive Directors

Job Purpose

To support the Chief Executive and work in partnership with the Cabinet and Council to develop their vision, plans and priorities and to identify the corporate policies and performance necessary to achieve them.

To lead the development of improvement strategies and ensure their successful implementation.

Main Functions

To lead the organisation by working with the Cabinet and other Councillors to create and articulate a vision, objectives and values for the organisation that meet the needs of the community and generate excitement and commitment.

To support the Chief Executive in general and specifically lead the development and implementation of corporate strategy and policy, taking account of the needs of different communities and sectors and the regional and national environment and by responding to opportunities and threats "on the horizon", in order to improve the Council’s services.

To promote diversity, inclusion and equality of opportunity throughout the Council’s workforce and services, being aware that positive change is often initiated by those who challenge the status quo, nurture divergent points of view, recognising their value in inspiring new ideas.

To work with the relevant Heads of Business Unit to develop service policies and strategies in order to deliver agreed objectives and core values and promote customer focus.

To ensure that Council policies and plans are suitably interpreted for clear and meaningful communication, that policies and strategies are in place to communicate with service users, partners, stakeholders and employees and that appropriate plans are implemented to obtain, evaluate and act upon feedback.

To be a role model of excellent performance and inspire others to improve performance.

To lead the delivery of efficiency and performance improvement programmes to optimise service delivery and continuous improvement and ensure a strong culture of performance management is established, ensuring that lines of accountability are clear and well understood and systems are in place for monitoring, evaluating and managing risk to secure the reputation and physical, virtual and intellectual resources of the Council.

To lead the strategic development and management of resources and the setting of corporate and service standards and targets; monitor and evaluate corporate performance against statutory obligations, standards and agreed corporate objectives. To promote learning and knowledge sharing across the organisation, seeking out new sources of information and new perspectives.

To promote co-operation across traditional functions for the benefit of the corporate agenda and learning and knowledge sharing across the organisation, seeking out new sources of information and new perspectives. To provide strategic and innovative leadership and bring new thinking, delivery mechanisms and solutions into the organisation.

To network strategically to turn ideas into reality and foster and maintain collaborative working between the Council, its services and external partners, building knowledge of the key stakeholders and influencing and negotiating as appropriate to build support for strategies and plans outside the realm of direct authority.

To provide perspective and make sense of the bigger picture in a complex and rapidly changing situation in order to guide staff into action, effective decision-making and an effective balance of short-term and long-term priorities.

To determine, establish and monitor the delivery of specific change programmes to meet agreed targets and objectives.

To lead budget and resource planning processes, ensuring that tensions between the demand upon service unit heads to deliver services and requirements to support strategic and cross-cutting initiatives are identified early in the process and properly resolved.

To support and mentor Heads of Business Units in managing, developing and accounting for their services, taking into account of the context set out in the attached document. In exceptional circumstances the Chief Executive may direct the postholder to intervene in or take full management responsibility for a particular Business Unit or part of it.

 

(d) Monitoring Officer and Chief Finance Officer

The Council will designate the following posts as shown:

(e) Functions of the Monitoring Officer

To maintain an up-to-date version of the Constitution and ensure that it is widely available for consultation by Members, staff and the public.

After consulting with the Head of Paid Service and Chief Finance Officer, to report to the full Council or to the Executive in relation to an executive function if he or she considers that any proposal, decision or omission would give rise to unlawfulness or if any decision or omission has given rise to maladministration. Such a report will have the effect of stopping the proposal or decision being implemented until the report has been considered.

To contribute to the promotion and maintenance of high standards of conduct through provision of support to the Standards Board.

To receive and act on reports from the National Standards Board for England and Ethical Standards Officers and decisions on their case tribunals.

To conduct investigations into matters referred by Ethical Standards Officers and make reports or recommendations in respect of them to the Standards Board for Bournemouth Borough Council.

To ensure that Cabinet decisions, together with the reasons for those decisions and relevant officer reports and background papers are made publicly available.

Where appropriate, in consultation with the Chief Finance Officer and the Chief Executive to advise whether Cabinet decisions are in accordance with the budget and policy framework.

To provide advice on the scope of powers and authority to take decisions, maladministration, financial impropriety, probity and budget and policy framework issues to all Councillors.

To contribute to the corporate management of the Council, in particular through the provision of professional legal advice.

The Monitoring Officer cannot be the chief finance officer or the head of paid service.

All those other functions and responsibilities as set out in the Council’s Financial Framework.

(f) Functions of the Chief Finance Officer

After consulting with the Head of Paid Service and the Monitoring Officer, to report to the full Council or to the Cabinet in relation to an executive function and the Council’s external auditor if he or she considers that any proposal, decision or course of action will involve incurring unlawful expenditure, or is unlawful and is likely to cause a loss or deficiency or if the Council is about to enter an item of account unlawfully.

To have responsibility for ensuring the proper administration of the financial affairs of the Council.

To contribute to the corporate management of the Council, in particular through the provision of professional financial advice.

To provide advice on the scope of powers and authority to take decisions, maladministration, financial impropriety, probity and budget and policy framework issues to all Councillors and will support and advise Councillors and Officers in their respective roles.

To provide financial information to the media, members of the public and the community.

To maintain the Council’s Financial Framework

All those other functions and responsibilities as set out in the Council’s Financial Framework.

12.3 Structure

The Chief Executive as Head of the Paid Service will determine and publicise a description of the overall departmental management structure of the Council (as set out in Part 7 of this Constitution)

12.4 Restrictions on Functions

The Head of Paid Service may not be the Monitoring Officer but may hold the post of Chief Finance Officer if a qualified accountant.

12.5 Duty to provide sufficient resources to the Monitoring Officer and Chief Finance Officer

The Council will provide the Monitoring Officer and Chief Finance Officer with such Officers, accommodation and other resources as are in the opinion of the above officers sufficient to allow their duties to be performed.

12.6 Conduct

Officers will comply with the Officers’ Code of Conduct and any Protocol on Officer/Member Relations set out in Part 5 of this Constitution.

 

12.7 Employment

The recruitment, selection and dismissal of Officers will comply with the Officer Employment Rules set out in Part 4 of this Constitution.
