Only the Council will exercise the following functions:
4.2.1. Appointing the Leader of the Council (who also acts as Chair of the Cabinet).
4.2.2 Approving Executive and non-Executive membership of Council Boards, Panels, Policy Advisory Groups and Area Forums in accordance with the wishes of the Group Leaders where they are politically balanced.
4.2.3 Approving the appointment of Executive and non-Executive elected Council Members to outside bodies (including joint authorities and Partnership Boards) at neighbourhood, sub-regional, regional and national levels.
4.2.4 Approving and reviewing the Council’s Constitution to ensure the continuous improvement of local democracy – including Rules of Procedure, financial regulations and the scheme of delegation for Cabinet functions, as recommended by the Cabinet, Overview Panels or Scrutiny Panels through Cabinet.
4.2.5 Scrutinising Cabinet minutes, openly questioning the Leader and other Cabinet Members and debating decisions on policies and service management taken by the Cabinet and Senior Council Officers.
4.2.6 Receiving reports from Cabinet, Overview Panels, Scrutiny Panels, Policy Advisory Groups, Statutory Boards and Area Forums, either directly or via Cabinet as appropriate.
4.2.7 Hearing representations on concerns and issues of interest raised by elected Members, the Public, Community Groups, Partners and other organisations.
4.2.8 Developing further opportunities for Members in Council to scrutinise decisions of the Cabinet and debate issues of specific or local concern.
4.2.9 Recommending revisions to the Bournemouth Community Plan for approval by the Bournemouth Partnership/Local Strategic Partnership.
4.2.10 Approving all of the Council’s key strategies, plans and policies as recommended by the Cabinet
4.2.11 Approving budgets proposed by the Cabinet, approving the Statement of Accounts and dealing with certain key statutory decisions (e.g. setting the Council Tax) and other matters reserved under the Constitution (e.g. election of Mayor).
NOTE: Approval of the Statement of Accounts has been delegated to the ‘Final Accounts Board’ – see Article 8: ‘Statutory Boards and Other Bodies’
4.2.12 Taking decisions on matters that do not accord with the established policy and budgetary framework.
4.2.13 Approving the appointment of the Chief Executive as Head of Paid Service, Directors, Chief Finance Officer and Monitoring Officer.
4.2.14 Making decisions about any matter in the discharge of a Cabinet function which is covered by the policy framework or the budget where the decision maker is minded to make it in a manner which would be contrary to the policy framework or contrary to/or not wholly in accordance with the budget.
4.2.15 To establish an Independent remuneration Panel and to adopt, on an annual basis, a Members’ Allowances scheme upon recommendation from the Remuneration Panel.
4.2.16 To adopt the Local Code of Conduct for Councillors upon recommendations from the Standards Board.
4.2.17 Changing the name of the area, conferring the title of honorary alderman or freedom of the Borough.
4.2.18 Appointing the Mayor and Deputy Mayor.
4.2.19 Making, amending, revoking, re-enacting or adopting bylaws and promoting or opposing the making of local legislation or personal Bills
4.2.20 All local choice functions set out in Part 3 of the Constitution which the Council decides should be undertaken by itself rather than the Cabinet.
4.2.21 Those functions set out in Sections 5-8 of the Licensing Act 2003, including, determining Licensing Policy and appointing a Licensing Committee.
4.2.22 All other matters which by law, must be reserved to the full Council.
4.2.23 The Council may delegate functions (Executive or non-Executive) to other local authorities as referred to in Article 11 of this Constitution.
