1.0 DELEGATIONS TO THE DIRECTOR ASSIGNED AS STATUTORY
CHILDREN DIRECTOR
1.1 The Director to be able to delegate such of the powers set out in this scheme of delegation to the appropriate Head of Business Unit or other professional officer as is required for that officer to effectively and efficiently carry out his/her duties.
1.2 To determine applications for mandatory and discretionary awards and student grants in accordance with the Council’s policy.
1.3 To determine all aspects of admissions, exclusions and appeals arrangements for LEA responsibilities consistent with policies of the Council.
1.4 To authorise persons at education establishments to exercise the power of removal of persons from
such premises contained in Section 40(3) of the Local Government (Miscellaneous Provisions) Act
1982.
1.5 To approve all necessary arrangements relating to the assessment, statementing and placement of pupils with special educational needs.
1.6 Responsibility for determining administrative issues associated with the appraisal of teachers and other staff consistent with established policies.
1.7 Consistent with corporate personnel policies, to determine all aspects of the implementation of pay and contract of employment arrangements within the Children, Schools and Families services.
1.8 To operate all operational and management aspects of the LMS scheme of delegation consistent with policies of the Council and the Cabinet.
1.9 To nominate additional Governors to schools in difficulties or withdraw delegation, where appropriate, in consultation with the appropriate Cabinet Member.
1.10 To approve alterations to and development of Education premises, subject to funding being available.
1.11 To set school term dates.
1.12 To agree and then distribute, LEA policy documents in relation to such matters as Health and Safety and school security arrangements.
1.13 To appoint LEA governors.
1.14 Formation and development of approved inter-agency groups and partnerships to deliver inter-agency services in accordance with the Financial Framework and legislation/regulation e.g. Children Act 2004.
1.15 To approve Instruments of Government submitted by School Governing Bodies.
1.16 To appoint serving governors to the Schools Group on the School Organisation Committee.
1.17 To appoint members of the School Admissions Forum and to the Schools Forum.
2.0 DELEGATIONS TO THE DIRECTOR ASSIGNED AS STATUTORY CHILDREN DIRECTOR
AND TO THE HEADS OF CHILDREN’S SERVICES, INCLUSION & ACHIEVEMENT AND SUPPORT FOR CHILDREN & YOUNG PEOPLE WHERE APPLICABLE TO SERVICES UNDER THEIR RESPECTIVE CONTROL
2.1 To enter into service contract arrangements and leasing and other similar arrangements consistent with the Council’s Financial Framework and with the approval of the Chief Finance Officer.
2.2 To respond to or initiate contact with Government departments, agencies and other relevant outside organisations consistent with policies of the Council and the Cabinet.
2.3 To undertake informal consultations in appropriate areas.
3.0 DELEGATIONS TO THE HEADS OF CHILDREN’S SERVICES, INCLUSION & ACHIEVEMENT AND SUPPORT FOR CHILDREN & YOUNG PEOPLE WHERE APPLICABLE TO SERVICES UNDER THEIR RESPECTIVE CONTROL
3.1 To determine applications for grants to voluntary organisations within approved estimates up to £500 and grants over £500 on the advice of the Officers’ Grants Panel.
3.2 To approve arrangements for training and development of staff outside of institutions operating formal delegation responsibilities.
3.3 To authorise reimburse travel, subsistence and other approved disbursements, consistent with Council policies for all staff outside of institutions operating formal delegation arrangements.
3.4 To approve all necessary recruitment, appointment and contract termination of staff outside of institutions operating formal delegation arrangements.
3.5 To determine fees and charges e.g. for Adult Education and the Hengistbury Head Outdoor Centre in accordance with the Financial Framework.
3.6 To establish Local Management and Advisory Groups in relation to matters such as Youth Projects.
3.7 To give approved body status to a ‘body of persons’ under Section 37(3) of the Children and Young Persons Act 1963 and the Council’s published policy so as to enable them to engage children in performances without the need to obtain child performance licences.
4.0 WITHDRAWAL OF AUTHORITY
The authority to exercise any of the above delegations may be withdrawn at any time by the Director or appropriate Head of Business Unit.
