1.0 GENERAL
1.1 In accordance with the Financial Framework, to negotiate and approve bookings for events, shows etc., including where appropriate the booking of artistes, the promotion of and setting of admission charges, to be held at land/establishments under the control of the Leisure service and Tourism service areas.
2.0 ENFORCEMENT
2.1 (a) To serve fixed penalty notices under the Environmental Protection Act 1990 for
the offence of dropping litter and to take all/any necessary further action to
recover payment.
(b) This authority is also hereby granted to the Leisure Services and Tourism Services Managers and Enforcement staff.
2.2 (a) In agreement with the Head of Law ad Corporate Governance to take the
necessary action, including legal action, in respect of any contravention of
Byelaws in facilities or on land under the control of the Leisure and Tourism
service areas.
(b) This authority is also hereby granted to the Leisure Services and Tourism Services Managers and Enforcement staff.
2.3 (a) In consultation with the Head of Law and Corporate Governance to sign and to
serve notices of direction to leave land and to remove vehicles and other
property and to institute proceedings in the Magistrates Court to seek orders
equiring the removal of vehicles and other property from the land in question
under Sections 77 and 78 respectively, of the Criminal Justice and Public Order
Act 1994.
(b) The authority to sign notices is also hereby granted to Leisure Services and Tourism Services Managers
(c) The authority to serve notices is also hereby granted to Enforcement staff.
2.4 With regard to the Dogs (Fouling of Land) Act 1996 in relation to those areas listed within the Schedule to the draft Order for which Leisure Services and Tourism Services are responsible:-
(a) To instruct the Head of Law and Corporate Governance to take legal
proceedings subject to satisfactory evidence.
(b) To investigate offences and issue fixed penalty notices.
The delegations at (a) and (b) above are also granted to the Leisure Services and Tourism Services Managers and Enforcement staff.
2.5 To enforce street trading in accordance with the provisions of the Local Government (Miscellaneous Provisions) Act 1982.
3.0 PURCHASING
3.1 To purchase amusement machines, land trains, play and sports equipment, specialised equipment and services, uniforms, marketing material, trees, plants, bulbs and horticultural supplies and associated supplies at the times considered most appropriate and within budgetary provision with these machines/supplies regarded as Proprietary Articles in accordance with the Rules of Procedure.
4.0 DISPOSALS
4.1 To advertise disposals of minor areas of public open space, subject to Ward Councillors being consulted before the advertisement is placed and to the results of the public consultation exercise being considered and determined by the Cabinet Member with the appropriate portfolio.
5.0 CONSENTS
5.1 To approve the renewal of applications for Street Trading Consents.
6.0 AGREEMENTS
6.1 Determination of minor agreements/licences and their renewals, where appropriate, in consultation with the Head of Resources.
6.2 Attend to wayleave consents, gas governor and electricity sub-station sites, telephone kiosks, etc. where a set formula exists for determination of the fee payable.
6.3 In agreement with the Head Resources/Head of Law and Corporate Governance to approve requests for the assignment of concessions.
7.0 MANAGEMENT ARRANGEMENTS
7.1 The day-to-day management and monitoring of directly provided or contracted services, with authority to make minor variations to service, terms and management arrangements.
7.2 To deal with applications for the use of swimming pools, sports centres and indoor and outdoor recreation facilities and the provision of tuition.
7.3 To deal with routine applications for the loan of equipment.
7.4 To issue tenancy agreements for allotments and to deal with all management arrangements.
7.5 To enter into ad hoc agreements of hire for the use of premises, not owned by the Council, for Leisure Programmes.
7.6 To determine applications for packages or free or concessionary use of leisure facilities.
7.7 To write off Excess Charge Notices where they have been issued incorrectly or in extenuating circumstances, for the car parks under his control.
7.8 To determine charges for facilities in accordance with the Financial Framework.
7.9 To prepare Management and Improvement Plans for areas of open space as identified in the Leisure Strategy or in the service’s Business Plan and to submit them to public consultation, provided that the Plans do not involve a change in land use policy and with the results of the consultation being reported to and determined by the Cabinet/Cabinet member with the appropriate portfolio.
7.10 In accordance with the Financial Framework, to make applications for grants, including grants from the National Lottery distributors.
7.11 To remove structurally dangerous trees where there is a significant risk to either property or person.
7.12 To determine the number of annual lettings of beach bungalows.
7.13 To offer an appropriate refund of the fees where appropriate in the interest of
effective customer care.
8.0 TOURISM
8.1 To contribute to specific joint projects/promotions in conjunction with relevant partners, which are considered to be of benefit to Bournemouth rather than making a general contribution towards the marketing budget.
8.2 To decide the level of entertainment expenses in connection with hospitality where appropriate.
8.3 That arising from the receipt of complaints against a Hotel advertising within the Bournemouth Guide, to take the appropriate action up to the possible exclusion of the Hotel from the Guide.
8.4 To approve payments of up to £10,000 from the Sponsorship Budget towards events that would in his opinion, be of significant benefit to Bournemouth.
8.5 To approve the increase in annual fees paid to the Meteorological Officer and the Hotel Inspector provided that it was in line with the annual increase in the Retail Price Index.
8.6 To set up Agency Agreements.
8.7 To formulate the overall Marketing and Media Plan and to allocate expenditure from within the global budget, as approved by the Cabinet, to those headings within the Plan.
8.8 To manage and be responsible for the Distinguished Visitors and Other Events Budget and to approve applications for such funds in accordance with the following criteria:-
"The giving of assistance through the Distinguished Visitors and Other Events Budget to those groups or organisations who the Council wishes to acknowledge as having contributed towards the promotion or enhancement of Bournemouth."
8.9 To continue to consider all planning applications for change of use in consultation with the Cabinet Member with the appropriate portfolio and that where such applications involve the loss of sites which would be considered detrimental to tourism or where the alternative use of the site would have a detrimental impact on the remaining tourism activities of the area, the Head of Tourism Services be authorised to submit the appropriate comments on that application.
8.10 To select individual lists of contractors for specific projects from within the Standing Lists of Approved Contractors for named categories of works.
8.11 To approve future applications for grant aid from the Marketing Partnership Fund:-
(a) up to a maximum of £10,000 provided that such approvals be reported retrospectively to the Cabinet; and
(b) up to £15,000 in the case of marketing opportunities which require an urgent decision,
in consultation with the Cabinet Member with the appropriate portfolio.
8.12 In consultation with the Head of Law and Corporate Governance to enter into contractual arrangements with partner organisations in accordance with the Financial Framework.
8.13 In consultation with the Head of Resources to negotiate minor agreements.
8.14 In consultation with the Heads of Resources and Street Services to authorise the release of funds from the Illuminations Partnership Fund where equivalent matched funding was available from sponsorship.
9.0 DELEGATION TO THE HEAD OF TOURISM SERVICES IN CONSULTATION WITH THE TOWN CENTRE MANAGER
9.1 Town Centre Civic Space
Day to day management of the activities in the pedestrianised areas of the Town Centre, subject to regular reports back to the Cabinet on the practical implementations of the Council’s agreed guidelines.
10.0 DELEGATION TO THE HEAD OF LAW AND CORPORATE GOVERNANCE
10.1 The administration and allocation of Teddy Bear stalls within policy guidelines; with the fee to be determined annually.
11.0 DELEGATION TO THE HEAD OF LAW & CORPORATE GOVERNANCE AND PRINCIPAL & SENIOR SOLICITORS
11.1 To issue proceedings with regard to the Dogs (Fouling of Land) Act 1996 in relation to those areas listed within the Schedule to the draft, Order for which Leisure Services and Tourism Services are responsible.
12.0 WITHDRAWAL OF AUTHORITY
The authority to exercise any of the above delegations may be withdrawn at any time by the appropriate Head of Business Unit.
