1. The powers and duties under the Bournemouth Borough Council Act 1985 listed below will be the responsibility of the decision-making bodies indicated .
Section 3: Safety of Stands, will be the responsibility of the Planning Board.
Sections 6–14: Night Cafes, inclusive will be the responsibility of the Licensing Board.
Sections 15–19: Fire Precautions, will be the responsibility of the Planning Board.
Section 53: Parking Agreements (in relation to development proposals), will be the responsibility of the Planning Board.
Part VI Parks and Amenities will be the responsibility of the Cabinet. The Cabinet will be required to act as Trustees in so far as any decisions relate to the Charitable Trusts in connection with the Five Parks.
Section 57 Russell Cotes Art Gallery and Museum - the Cabinet will be required to act as the Management Committee as set out by Section 57 sub-section 3 (a) of the Act. The Cabinet will be responsible for exercising functions under Sections 63 and 64 of the Act relating to prosecutions for breaches of the Act except where those breaches relate to functions specifically delegated as set out above.
(Any function under the Bournemouth Borough Council Act 1985 not listed above will be discharged by the Cabinet or as specifically delegated by them to a specified Officer or Member.)
The determination of an appeal (where such appeal is provided by the relevant legislation) against any decision made by or on behalf of the authority will be dealt with by the Appeals Board, subject to further delegation.
The appointment of review boards under regulations under subsection (4) of section 34 (determination of claims and reviews) of the Social Security Act 1998. This will be dealt with by the Appeals Board, subject to further delegation.
The making of arrangements pursuant to subsection (1) of section 67 of, and Schedule 18 to, the School Standards and Framework Act 1998 (appeals against exclusion of pupils) will be dealt with by the Cabinet, subject to further delegation.
5. The making of arrangements pursuant to section 94(1) and (4) of, and Schedule 24 to, the 1998 Act (admission appeals) will be dealt with by the Cabinet, subject to further delegation.
6. The making of arrangements pursuant to section 95(2) of, and Schedule 25 to, the 1998 Act (children to whom section 87 applies: appeals by governing bodies). This will be dealt with by the Cabinet, subject to further delegation.
7. The making of arrangements under section 20 (questions on police matters at council meetings) of the Police Act 1996 for enabling questions to be put on the discharge of the functions of a police authority. This will be dealt with by Full Council, subject to recommendation by the Cabinet.
8. The making of appointments under paragraphs 2 to 4 (appointment of members by relevant councils) of Schedule 2 (police authorities established under section 3) to the Police Act 1996. This will be dealt with by Full Council, subject to recommendation by the Cabinet.
9. The conducting of Best Value reviews in accordance with the provisions of any order for the time being having effect under Section 5 (Best Value Reviews) of the Local Government Act 1999. This will be dealt with by the Cabinet (responsible for the overall framework for Best Value) and the Scrutiny and Review Panels (responsible for the operational conduct and scrutiny of best value service reviews).
10. Any function relating to contaminated land will be dealt with by the Cabinet, subject to further delegation.
11. The discharge of any function relating to the control of pollution or the management of air quality will be dealt with by the Cabinet, subject to further delegation.
12. The service of an abatement notice in respect of a statutory nuisance will be dealt with by the Cabinet, subject to further delegation.
13. The passing of a resolution that Schedule 2 to the Noise and Statutory Nuisance Act 1993 should apply in the authority's area will be dealt with by the Cabinet, subject to further delegation.
14. The inspection of the authority's area to detect any statutory nuisance will be dealt with by the Cabinet, subject to further delegation.
15. The investigation of any complaint as to the existence of a statutory nuisance. Will be dealt with by the Cabinet, subject to further delegation.
16. The obtaining of information under section 330 of the Town and Country Planning Act 1990 as to interests in land will be dealt with by the Planning Board, subject to further delegation.
17. The obtaining of particulars of persons interested in land under section 16 of the Local Government (Miscellaneous Provisions) Act 1976 will be dealt with by the Planning Board, subject to further delegation.
18. The making of agreements for the execution of highways works will be dealt with by the Cabinet, subject to further delegation.
19. The appointment of any individual –
(a) to any office other than an office in which he is employed by the authority;
(b) to any body other than –
(i) the authority;
(ii) a joint committee of two or more authorities; or
(c) to any committee or sub-committee of such a body, and the revocation of any such appointment.
