46 Work for Third Parties

46.1 Overview

The Authority can provide a range of services to other bodies.  Such work may enable a unit to maintain economies of scale and existing expertise.  Arrangements should be in place to ensure that any risks associated with this work is minimised and that such work is within the Council’s legal powers.

46.2 Responsibility/Accountability

46.2.1 Cabinet (click here for all responsibilities for the Cabinet)

Approving the contractual arrangements for any work for third parties or external bodies.

46.2.2 Monitoring Officer (click here for all responsibilities for the Monitoring Officer)

Advising on the legal implications of any third party proposals.

46.2.3 Section 151 Officer (click here for all responsibilities for the Section 151 Officer)

Issue guidance with regard to the financial aspects of third party contracts and the maintenance of the contract register.

46.2.4 Business Unit Heads (click here for all responsibilities for Business Unit Heads)

Ensure that the approval of the Cabinet is obtained before any negotiations are concluded to work for third parties.

Provide information to the Monitoring Officer for the maintenance of a register of all contracts entered into with third parties.

Ensure that a risk assessment is undertaken and all necessary insurances are in place.

Ensure that no contract is subsidised by the Authority.

Ensure that, wherever possible, payment is received in advance of the delivery of the service.

Ensure that the Service has the appropriate expertise to undertake the contract.

Ensure that such contracts are complimentary to the services provided for the Authority.

Ensure all contracts are properly documented.

Provide appropriate information to the Section 151 Officer to enable a note to be entered into the statement of accounts.

All contracts for third party work must be drawn up and approved using the established procedure.

A register of contracts is maintained and monitored by the Head of Law and Corporate Governance.
