20. ACCESS TO DOCUMENTS BY OVERVIEW PANELS AND SCRUTINY PANELS
Rights To Copies
Subject to Rule 21.2 below, an Overview Panel or Scrutiny Panel (including sub-committees) will be entitled to copies of any document which is in the possession or control of the Cabinet or its committees and which contains material relating to:-
any business transacted at a public or private meeting of the Cabinet [or its committees]; or
any decision taken by an individual member of the Cabinet.
Limit On Rights
An Overview Panel or Scrutiny Panel will not be entitled to:
any document that is in draft form;
any part of a document that contains exempt or confidential information, unless the Monitoring Officer determines that the information is relevant to (i) an action or decision they are reviewing or scrutinising or (ii) any review contained in an Overview Panel or Scrutiny Panel Work Programme; or
the advice of a political adviser.
21. ADDITIONAL RIGHTS OF ACCESS TO INFORMATION FOR MEMBERS
Material Relating to Previous Business
All Members of the Council will be entitled to inspect any document which is in the possession or under the control of the Cabinet or its committees and contains material relating to any business previously transacted at a private meeting unless either (a), (b) or (c) below applies.
(a) it contains exempt information falling within paragraphs 1,2,4,5 and 7 of the categories of exempt information;
(b) it contains information relating to any terms proposed or to be proposed by or to the Council in the course of negotiations for a contract.
c) it contains the advice of a political advise of a political adviser.
Material Relating To Key Decisions
All Members of the Council will be entitled to inspect any document (except those available only in draft form) in the possession or under the control of the Cabinet or its committees which relates to any key decision unless paragraph (a), (b) or (c) above applies.
Nature of Rights
These rights of a Member are additional to any other right he or she may have.
