The Legislation

 

The Council is under an obligation to provide and protect business and personal information that it holds. The main legislation that helps us to do this is: 

The Freedom of Information Act (FOIA)

An Act which gives you access to recorded business information held by the Council, so that you can find out more about what the Council does and how it makes decisions.

Environmental Information Regulations (EIR)

A Regulation similar to FOIA which gives you access to recorded business information held by the Council in respect of the environment including soil, air or water quality and any development of land or building work.

Data Protection (DPA)

An Act which protects personal information the Council holds about living individuals and a right of access to personal information the Council holds about you as an individual. 

Regulation of Investigatory Powers Act (RIPA)

An Act which permits the Council to use covert surveillance to protect the public and prevent crime.

Human Rights Act (HRA) and Common Law Duty of Confidentiality (CLDC)

The HRA and CLDC protect personal and private information the Council holds about individuals.  The Council is required to take both of these into consideration when sharing or disclosing personal information about individuals.
