OBJECTIONS AND REPRESENTATIONS TO APPLICATIONS

For new licences and variations to existing licences/certificates, representation can be made regarding the likely effect of the grant in relation to the four licensing objectives.  These can be made by: -

  • A Responsible Authority
  • An Interested Party
  • Any person living in the vicinity of the premises
  • Any body representing such persons
  • Any person involved in a business in the vicinity
  • And/or a body representing such persons

Representations will not be considered where the Licensing Authority considers them to be frivolous, vexatious, repetitive or not relevant.

IMPORTANT NOTE: A copy of all representations are sent to the applicant who may contact the Interested Party/Responsible Authority making the representation directly with a view to mediation.  If such mediation is not successful, or the applicant chooses not to make contact, the representation and name and address of the Interested Party/Responsible Authority will subsequently be disclosed within a report to the Licensing Sub-Committee, should the matter go to hearing.  This is a public document and available to view by any person on request.  If you any Interested Party does not wish their information to be included within such public documents they should notify the Licensing Team.  This does not however prevent such information being passed to the applicant, or their authorised agent, to respond accordingly.

HEARING AND PROCEDURES

We are required to give notice of the date, time and place where hearings will be held.  Hearing have to be held within a specified period of time beginning with the date after which a particular licence process has been completed.  A Notice of Hearing document will be sent to any person who has made a valid representation to an application together with the attached procedure.
