Article 11 JOINT ARRANGEMENTS

11.1 Joint Arrangements

11.1.1 The Council or the Cabinet, in order to promote the economic, social or environmental well-being of its area may:

enter into arrangements or agreements with any person or body;

co-operate with, or facilitate or co-ordinate the activities of, any person or body; and

exercise on behalf of that person or body any functions of that person or body.

11.1.2 The Council may establish joint arrangements with one or more local authorities and/or their executives to:

exercise functions which are not executive functions in any of the participating authorities; or

advise the Council on matters of joint interest.

Such arrangements may involve the appointment of a joint committee with those other Local Authorities.

11.1.3 The Cabinet may establish joint arrangements with one or more local authorities to exercise functions which are executive functions. Such arrangements may involve the appointment of joint committees with these other local authorities.

11.1.4 Except as set out below, the Cabinet may only appoint Cabinet Members to a joint committee and those Members need not reflect the political composition of the local authority as a whole.

11.1.5 The Cabinet may appoint Members to a joint committee from outside the Cabinet in the following circumstances:

The joint committee has functions for only part of the area of the Borough, and that area is smaller than two-fifths of the authority by area or population. In such cases, the Cabinet may appoint to the joint committee any Councillor who is a Member for an electoral ward which is wholly or partly contained within that part of the Borough;

In this case the political balance requirements do not apply to such appointments.

11.1.6 The Council may establish joint arrangements with one or more local authorities to advise on matters of joint interest or to undertake functions which are not the responsibility of the Cabinet. The political balance requirements will apply to the allocation of seats by the Council on joint committees which advise the Council or undertake functions which are not the responsibility of the Cabinet.

11.1.7 Details of any joint arrangements including any delegations to joint committees will be found in the Council’s scheme of delegations in Part 3 of this Constitution.

11.1.8 Any joint arrangements should have regard to the Financial Framework/Regulations of the Council.

11.2 Access to Information

11.2.1 The Access to Information Procedure Rules on Part 4 of this Constitution apply.

11.2.2 If all the members of the joint committee are members of the Cabinet (or equivalent) in of the participating councils then its access to information regime is the same as that applied to the Cabinet.

11.2.3 If the joint committee contains members who are not on the Cabinet (or equivalent) of any participating councils then the access to information rules in Part VA of the Local Government Act 1972 will apply.

11.3 Delegation to and from other local authorities

11.3.1 The Council may delegate non-executive functions to another local authority or, in certain circumstances, the executive of another local authority.

11.3.2 The Cabinet may delegate executive functions to another local authority or the executive of another local authority in certain circumstances.

11.3.3 The decision whether or not to accept such a delegation from another local authority shall be reserved to the Council meeting.

11.4 Terms of reference and membership of joint bodies

11.4.1 Executive Functions

11.4.1.1 Bournemouth, Dorset and Poole Structure Plan Joint Committee

 

Terms of Reference

Bournemouth and Poole Unitary Authorities and Dorset County Council are committed to working together to provide effective structure planning for their combined areas.

They agree to establish and maintain a joint committee of their Elected representatives to exercise, on their behalf, the structure planning functions defined in an agreed protocol.

The Joint Committee will undertake preparation, alteration and replacement of the Structure Plan; monitoring and implementation of the Plan (including associated research and information); and other related functions, such as regional planning, subject to the approval of the consultant authorities.

Membership

Six Members each of Bournemouth Borough Council, Borough of Poole and Dorset County Council.

(Substitute members for each political group represented on the joint committee are also appointed to ensure full representation of this Council.)

(Quorum will comprise at least two representatives of each authority and at least ten representatives in total.)

One Member from each Borough/District Council may attend as observers.

11.4.1.2 Dorset Minerals and Waste Local Plan Joint Committee (Ad Hoc)

Terms of Reference

To consider and jointly recommend changes to the Dorset Minerals and Waste Local Plan to the three parent authorities.

Membership

Two Members from each of Bournemouth and Poole Borough Councils and four Members of Dorset County Council.

 

 

11.4.1.3 Joint Transport Liaison Panel

Terms of Reference

To monitor and review the effectiveness of all joint policies, working arrangements and protocols between the constituent authorities for highway and transportation services

To co-ordinate, where appropriate, the following:

Annual Transport Policies and Programme submissions to the Government Office for the South West.

The Public Education campaign for transport awareness.

Any public transport initiatives which affect more than one of the constituent authorities.

Membership

Three Members each from Bournemouth Borough Council, Poole Borough Council and Dorset County Council. The Chairmanship to rotate annually.

One Member each from Christchurch Borough Council, Purbeck District Council and East Dorset District Council. These Members do not have any voting rights.

11.4.1.4 Strategic Arts Review Group

Terms of Reference

To develop, monitor and review the Joint Arts Policy.

Membership

Seven Members from each of Bournemouth, Christchurch and Poole Borough Councils.

(NOTE: Memberships of these joint bodies are currently the subject of review in the context of the arrangements for the New Council)
