What is a Non-Statutory Plan

If your child doesn’t need an Education Health & Care Plan (EHCP) we’ll write a non-statutory plan (NSP), based on their assessment

If your child’s current nursery, school or college meets their needs, we won’t write an EHCP.

We’ll use the information from their assessment to put together a NSP to describe their special educational needs and the support that will benefit them the most.

The NSP will explain why we’ve decided your child doesn’t need an EHCP. We’ll send you the NSP 16 weeks after the original request for an assessment was made.

If you disagree with our decision, you can appeal through a SEND Tribunal. You have to register your appeal within two months of getting our decision.
